High Court Cancels $33.3 million lawsuit against Justmoh Construction

The Accra High Court has overturned a thirty-three million dollars (US$33.3 million) arbitral award against Justmoh Construction linked to the Boankra Inland Terminal Port in the Ashanti region.

The case that was ruled in favor of Ashanti Port Service Limited (APSL) in December, 2025 was set aside due to defects in the court proceedings after it was pleaded by Justmoh Construction.

The case presided over by Judge John-Mark Nuku revealed that the APSL’s board was not properly constituted under the stakeholders agreement as of December, 2023, when they filed the case at the court.

The court revealed that Justmoh’s participation in the court proceedings did not contribute significantly to it.

The court added that the Ghana Port and Harbour Authorities could have paid the US$33.3 million to Justmoh directly as per the initial agreement with the APSL.

The High Court ruled that the amount which was paid to Justmoh by the judicial tribunal after the arbitration should be refunded with interest.

APSL engaged Justmoh Construction during phase 1A of the project and was expected to pay US$33.3 million to Justmoh to mobilize the work.

The APSL failed to meet the financial demand in August 2023, after the GSA terminated the contract.

The High Court’s decision relieves Justmoh of repayment duties but leaves the Boankra Inland Port project at an intersection.
